Dispute Resolution
You agree that any dispute or claim (including personal injury claims) related to your use of the website is subject to the exclusive jurisdiction of Province of Ontario, Canada, and will be adjudicated pursuant to the laws of the Province of Ontario and the federal laws of Canada applicable therein. This agreement also applies to anyone claiming on your behalf. You expressly agree that any claims, lawsuits, actions, complaints, disputes, controversies, or other matters in any way related to BarLaw or arising out of use of this website will be settled solely and exclusively through binding arbitration pursuant to the National Arbitration Rules of the ADR Institute of Canada, Inc. The arbitration will take place in Toronto, Ontario, Canada. You expressly agree that any such arbitrator has personal jurisdiction over you and you waive all defences of lack of personal jurisdiction and forum non conveniens. By agreeing to arbitration, you expressly waive any right to a trial by jury, and you expressly waive any right to initiate or become a member of a class proceeding against BarLaw. You agree to abide by all decisions and awards rendered in such arbitration proceedings, and that such decisions and awards rendered by the arbitrator will be final and conclusive. You agree that the arbitrator will not have the right to award punitive damages or speculative damages. The arbitrator will be required to follow the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Severability
If any of these Terms and Conditions is deemed to be invalid, void, or for any reason unenforceable, that specific term or condition is deemed severable and all other terms and conditions will nevertheless remain in full force and effect. Each term and condition will be valid and enforceable to the fullest extent permitted by law and any invalid, illegal, or unenforceable term or condition will be deemed replaced by a term or condition that is valid and enforceable and that comes closest to expressing the intent of the invalid, illegal, or unenforceable term or condition.
